Re: Reply to Complaint of Danielle Dayrell dated 04/25/09, published March 2010
Dear Sir or Madam;
This letter is to address the complaints raised by Danielle Dayrell against Davison, Design and Development, Inc. (Davison). We at Davison take pride in our work and endeavor to provide our clients with the highest level of service. As such, any concerns expressed by our clients are taken seriously and we will work to resolve any justifiable conflict. In her complaint, Ms. Dayrell alleges that Davison charged fees against her credit card without authorization, and that she has not received a total refund. As will be detailed below, her claims are without support.
On or about April 21,2009 Ms. Dayrell entered into a written contract for services with Davison. On the signatory page of the contract, Ms. Dayrell explicitly, in writing, authorized the charge of $556.00 from her debit card. Not only did she authorize the charge, she explicitly noted, again in writing, to debit the full amount of $556.00. Davison charged the fee in accordance with her explicit instructions.
On or about April 22, 2009, Ms. Dayrell requested a refund of the fees charged. Davison executed this refund by electronic transfer on the same date, specifically at 11:54 AM on the 22nd. Also, on April 22, 2009, Ms. Dayrell provided a second credit card to Davison and verbally authorized a charge of $100.00 as partial payment. Again on April 23, 2009, Ms. Dayrell verbally authorized a second charge of $200.00 to the second card provided. Davison processed these two authorized charges. On or about April 27, 2009, Ms. Dayrell faxed a request to rescind the contract and refund the $300.00 which had been charged. This refund was made at 3:26 PM on the 27th.
Despite having received a complete refund of all monies paid, Ms. Dyarell filed a complaint with her credit card company, who forwarded a request for information to Davison on or about April 30, 2009. On or about May 8, 2009, Davison responded to the credit card company by providing the details of the transactions noted above.
Records documenting the details referenced in this response are available. In summary, Ms. Dayrell received a total refund of any and all fees charged the very day she made such a request. Davison's conduct n the handling of her situation was prompt, respectful and professional.
Sincerely ,
/s/Frank Vescio
